These Website Terms of Use (“Terms”) govern your use of www.provalet.io and its subdomains and related public pages (the “Site”), operated by Pure Coastal Technologies, Inc. d/b/a ProValet (“Pure Coastal,” “we,” “us”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
This summary is for convenience only. The numbered sections control.
These Terms cover browsing our website — reading the blog, downloading a guide, filling in a demo form. They do not govern the ProValet product. If you use ProValet as a service company, a technician, or a homeowner, a separate agreement applies to you and is linked in Section 2.
In short: the Site is informational, our content is ours, don’t scrape or misuse it, we don’t guarantee the accuracy of blog and guide content, and disputes go to individual arbitration with a 30-day opt-out.
The Site is an informational and marketing website. Content on it — including blog posts, guides, route intelligence articles, comparison pages, case studies, and pricing pages — is provided for general information. It is not a contract, a quote, a warranty, or professional advice, and product descriptions and pricing on the Site may change and are superseded by your actual order and agreement.
These Terms govern the Site only.
If you use ProValet itself — as a service company, as a technician, or as a homeowner or customer — a separate agreement applies to you, and that agreement, not these Terms, governs your use of the product. The agreement that applies to you is presented to you for review and acceptance when you sign up, accept an invitation, or first use your account, and remains available to you from within your account at any time.
Our Privacy Policy applies to this Site and to the ProValet products, and is incorporated into these Terms.
If you need a copy of the agreement that applies to you, or you are evaluating ProValet and would like to review the applicable terms before signing up, contact us at privacy@provalet.io.
You may view, download, and print Site content for your own informational or internal business use. You may not:
The Site and its content, design, and code are owned by Pure Coastal or its licensors and are protected by intellectual property laws. “ProValet,” our logo, and our marks are ours. Third-party names and marks appearing on the Site — including on comparison pages — belong to their respective owners and are used for identification and comparative purposes only. Their use does not imply affiliation with or endorsement by those owners.
If you submit a demo request, contact form, newsletter signup, referral or affiliate application, or similar, we handle that information under our Privacy Policy. Do not send us confidential information, trade secrets, or anyone else’s personal information through the Site.
Anything you submit that is not personal information is deemed non-confidential, and you grant us a licence to use it to respond to you and to operate our business.
If you submit feedback, ideas, or suggestions about our products, we may use them without restriction, obligation, or compensation.
The Site links to third-party sites and services we do not control. We are not responsible for their content, products, or practices, and a link is not an endorsement. Review their terms and privacy policies yourself.
The Site uses cookies, analytics, and advertising technologies, including those of Google and Meta. Under some state privacy laws this may constitute a “sale” or “share” of personal information. You can opt out using the “Do Not Sell or Share My Personal Information” link in the Site footer, or by enabling Global Privacy Control in your browser — we honor GPC. See the Privacy Policy for detail.
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, PURE COASTAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that Site content is accurate, complete, or current. Guides, benchmarks, comparison pages, pricing illustrations, and blog content are general information and should not be relied on as business, legal, tax, or professional advice. Competitor comparisons reflect our understanding at the time of writing and may become outdated.
TO THE FULLEST EXTENT PERMITTED BY LAW, PURE COASTAL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
Where you have a ProValet product agreement, the liability provisions of that agreement govern claims relating to the product.
Some jurisdictions do not allow these limitations, in which case our liability is limited to the greatest extent permitted by law. Nothing here limits liability for fraud or for personal injury caused by our negligence.
If you believe content on the Site infringes your copyright, send a notice under the Digital Millennium Copyright Act to privacy@provalet.io or to Pure Coastal Technologies, Inc., 365 5th Avenue South, Suite 201, Naples, FL 34102, Attn: DMCA Agent. Include the information required by 17 U.S.C. § 512(c)(3). We will respond appropriately, including by removing infringing material and terminating repeat infringers.
(a) Informal resolution first. Contact us at privacy@provalet.io describing the dispute and the relief you want. Both of us agree to try in good faith for 60 days.
(b) Arbitration. If we can’t resolve it, disputes arising out of these Terms or the Site will be resolved by final and binding individual arbitration administered by the AAA — under its Consumer Arbitration Rules where you are an individual — and the Federal Arbitration Act governs. This means we each give up the right to sue in court and to a jury trial, except as stated below.
(c) CLASS ACTION WAIVER. CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If this paragraph is found unenforceable as to a claim, that claim proceeds in court under Section 11(f) and the rest proceed in arbitration.
(d) Exceptions. Either of us may bring an individual claim in small claims court, and either may seek injunctive relief in court to protect intellectual property or stop misuse of the Site. Nothing here stops you from contacting a government agency.
(e) YOUR RIGHT TO OPT OUT. You may opt out of Sections 11(b) and 11(c) by writing to privacy@provalet.io or the address above within thirty (30) days of first accepting these Terms. Include your name, contact details, and a clear statement that you are opting out. Opting out affects nothing else.
(f) Governing law and venue. Florida law governs, without regard to conflict of laws rules, except that the FAA governs Section 11 and except where the mandatory consumer law of your state gives you greater protection. For claims not in arbitration, venue is the state or federal courts in Collier County, Florida — except you may bring a qualifying claim in small claims court where you live. IF A CLAIM PROCEEDS IN COURT, WE EACH WAIVE THE RIGHT TO A JURY TRIAL.
(g) This Section survives termination. Changes to this Section do not apply retroactively to a dispute we already had written notice of.
We may change the Site or these Terms at any time. We will post the updated Terms with a new “Last updated” date. Continued use after the change takes effect means you accept it.
These Terms and our Privacy Policy are the entire agreement between you and Pure Coastal regarding the Site. If a provision is unenforceable it will be modified to the minimum extent necessary or severed, and the rest remains in effect. You may not assign these Terms; we may assign them in a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver of it.
